Minutes for Jan 12, 2016 POA Meeting

Meeting was held at the Christian Family Baptist Church and was called to order at 7:30 PM by President Frank Partee.

New Business

Presentations by various government entities were made first.

Tony Vasquez, Bexar County Public Works Division Chief, explained that a site analysis of our subdivision was done.  As a result of this study, there will be a four way stop installed at Silver Maple and Bois D’Arc.  Construction starts the end of the month.  A sign that flashes your car speed will be installed sometime after that on Silver Maple as you turn into the subdivision from Potranco Rd.  Also, American Lotus is being cut through to Grosenbacher which should relieve some of the traffic coming into the subdivision on Yellow Birch.  Any requests for a capital improvement project for sidewalks will need to be sent through the commissioner’s office but would be a lower priority due to other major issues in the county.  Enforcement of speed limits, stop signs, etc must be addressed with the Sheriff’s department.

State Representative Rick Galindo spoke next.  He is currently serving on the committees for Public Education, Mental Health, and  GTO (Government Transparency).  He lives in Amhurst and is aware of the problems out here and we are one of the fastest growing areas in the state.  If you have any concerns, contact his office at 210-922-1336.  He advised us of an upcoming Annexation Town Hall Meeting on Thursday, Jan 28. 2016, 7 PM at Hoffman Elementary Cafeteria.

TXDOT was represented by Christine Longoria and Marco Galindo.  They provided us with handouts on the major highway projects in our area -410/151 Interchange, 410/90 Interchange, and Loop 1604 expansions from Culebra to Hwy 90.

Bridell Miers spoke on Bexar County Capital Projects which includes expansion of Potranco Rd.  Waiting on TXDOT approval of contract, then it goes to Commisioner’s Court and construction to start in March, 2016.

Gabirel Lara, Coolcrest resident, is concerned about the length of time the county takes to get things done and is considering running as an independent for Commissioner Precinct 1.

Minutes from the Nov 10, 2015 meeting were read and approved.

Treasurer’s report was read and approved.  It was approved that the CDs coming up for renewal Feb 3, 2016 will be rolled into 13 month CDs.

Discussion held regarding the Fireworks stand at the old El Gato Tire Shop.  Owner of property will be contacted and told that no future fireworks stands will be allowed.  POA has previously voted that no fireworks will ever be allowed to be sold in the subdivision.

Open Forum

Sharon will get with the property owner of the lot across from Tink A Taco.  Kids are driving and spinning out in there and slinging mud onto Silver Maple.

House at corner of Silver Maple and Grapevine has been vacant a long time.  The yard was just recently mowed but parts of the roof have blown off.  Complaints have been made to the county.

Albert will get with Pastor Rob and Sylvia from Chico’s office to set a date for the dumpsters to be brought out.  It will be sometime after March 8.

Minutes for Nov 10, 2015 POA Meeting

Meeting was held at the Christian Family Baptist Church and was called to order at 7:30 PM by President Frank Partee.

Minutes from the Sept. 8, 2015 meeting were read and approved.

Treasurer’s report was read and approved. Question was asked about the cost of the lights and why there is a difference in the cost. It was explained that the cost difference is due to the light output.

Old Business

Update on Potranco road construction was given. Construction is now to start on Jan. 4, 2016.

There was no update on the food bank.

Update on brush pick up. Albert has been in contact with Sylvia from Mr. Rodriguez’s office and was told that the money has been approved for the dumpsters and they are waiting on a date when they can supply the dumpsters. Pastor Rob of CFBC has said there are 2 weekends a month when we can use their property to place the dumpsters so it is a matter of coordinating the time between when the dumpsters will be available and when we can use the church property.

There were 11 spots sold for the flea market for $170.00.

Frank brought up the possibility of collecting parking fee at Potranco Automotive for POA funds. Rudy has not been approached with this idea and it was pointed out that Rudy has an agreement with the bar that they can use his parking lot. It was also mentioned that there could be a liability issue. The discussion was dropped for now.

The Bylaws have been updated and need to be taken to the courthouse to be filed.

New Business

Plans were approved for the corner lot of Grosenbacher and Potranco roads for construction of Excel ER.

Plans for moving in a mobile home on lot 7, 12220 Madrona, and lot 8, 12214 Madrona were approved.

Safety report from BCSD. Richard reported that a meeting with Chico Rodriquez, the Bexar County Sheriff’s Dept, and the traffic control division and the POA is pending. Richard said he will call on Nov. 11, 2015 to follow up for a date for that meeting.

Election of Board Officers will be at the Jan. 12, 2016 meeting.

Open Forum

Mr. Jones commented that due to Amhurst tying in with Coolcrest he is now having flooding issues that he has never had before. Frank suggested that he contact the Bexar County Public Works Dept.

Albert approached Tink A Taco about hanging the Christmas in the trees and was told that would be OK but the electrical outlet was damaged. Albert said he would fix it. It was decided that the lights would be hung at 10:00 AM on Dec. 5, 2015.

Minutes for Sept. 8, 2015 POA Meeting

Meeting was held at the Christian Family Baptist Church and was called to order at 7:31 PM by President Frank Partee.

Old Business

A Board Workshop had been held to discuss changing of By-Laws. Changes were recommended but some questions arose and Richard contacted our attorney for clarification.  To change the Deed Restrictions, we would need unanimous approval from all property owners.  In the By-Laws, Section 13.01 addresses changes by majority of a quorum of the membership at two consecutive meetings (15% of property owners or approx. 52 owners); however, there is an alternative.  Under Section 22.102)(c) of the Business Organizations Code, the Board can amend the By-Laws unless the members expressly provide that the Board can not do so which the members have not done.  Richard will do a revision of the By-Laws and then schedule a Board Meeting

Albert reported that Pastor Rob agreed to let us use the church property for a community brush/trash pickup.  Albert has called the Commissioner’s office but has not received a response yet.  Albert/Frank will follow-up on this.

Richard has contacted the Commissioner’s office regarding speeding on Silver Maple and the need for speed bumps.  No response yet.

Old Business

Revision of the bylaws need to take the 2011 Legislative changes for POAs into consideration.  There will be a Special Board Meeting on July 28 at 1:00 PM at Richard Garza’s house.to work on proposed bylaw changes.

Deed Restriction changes are currently being tabled.

Flea Market vs Craft Sale – There was very little response to email that Linda sent to Coolcrest residents and Flea Market participants.  We will have both and separate areas for each.  Reservations will be taken if they want to make one.

Potranco Rd. Expansion now delayed till December, 2015

Open Forum

July 18 from 11:30 AM – 3:30 PM there will be a Fish Fry here at the church.  Plates are $10.  This is a fund raiser for the Food Bank Distribution that the church does monthly.  Donations will be accepted.  Contact Pastor Rob at 210-663-2249.  Linda will send out email to Coolcrest residents.

Richard will get the new Food Bank Distribution dates to Linda for posting on website.

The county is getting ready to re-do our roads.

Albert will check with Pastor Rob about using space at the church to set up a community dumpster day through the county & our County Commissioner.

Minutes for May 12, 2015 POA Meeting

Meeting was held at the Christian Family Baptist Church and was called to order at 7:30 PM by President Frank Partee.

Old Business

Potranco road expansion now slated to start August.  They will be working 6 days a week to get it done.  Phase 1 – 8 months.  Phase 2 – 8 months.

POA Bylaws revision committee was established to review them and see what needs to be updated and/or changed & report at next meeting.  Members are Frank Partee & Richard Garza.

Deed Restrictions revision discussion suspended for the time being.

Discussion regarding the POA Flea Market resulted in deciding to hold it only twice a year in April and October and to increase space fee to $15.00 plus $10.00 refundable deposit.  Recommendation made to have a craft sale instead of flea market.  Linda will send out feelers to see if there is any interest.  We would have limited spaces and take reservations.  Frank & Richard will contact neighboring subdivisions to see when they hold their garage sales.

New Business

Property at 12208 Madrona is being foreclosed on.  If you want information, let me know and I will forward the email notice I received.

Email received from Gary Rose at SWWC advising us that due to recent rains, the drought restriction for Coolcrest is being lowered to Stage 2.  I will send email to Coolcrest residents.

After prior POA meeting, Ms. Hernandez submitted an email request for a  1 year extension to complete construction on the home at 12154 Manzanita.  Extension was approved to March 15, 2016 and I will send an email to that effect.

Tink A Taco bought the property next door to them.

Bulletin board may be inside the property line but should be grandfathered in.

Minutes for the Mar. 10, 2015 POA Meeting

Meeting was held at the Christian Family Baptist Church and was called to order at 7:35 PM by President Frank Partee.

Old Business

Potranco road expansion now slated to start the end of April or May

Plans for the house at 12205 Poinciana were submitted by Mr. Blas Ortiz but failed to provide on which lot the house is located or the boundaries to the front and side of the lot.  Frank will draft a response asking for this information.

A bin to hold the deed restrictions was attached to the bulletin board.

Flea Market Dates were set for Apr 11, May 2, Jun 6, Sep 12, Oct 3, and Nov 7 weather permitting. Linda will get the dates to Potranco Automotive.

New Business

Letter will be sent to Ms. Bertha Encino regarding the house under construction at 12118 Poinciana.  Waiver previously granted has expired and house has not been completed.

Deed Restriction sign will be put on the bulletin board.

Trash pickup and taking down the Christmas lights will be Saturday, Mar 14 at 9:00 AM.  Linda will send email asking for volunteers

Discussion held regarding the update of the bylaws.  A majority of a quorum (15% of property owners is a quorum) is needed at 2 consecutive meetings.  Nothing decided so there will be further discussion at next meeting.

Discussion held on deed restriction changes.  Some deed restrictions are outdated and any changes would not affect current property owners.  Attorney stated that 51% of property owners would be needed for these changes.  Frank thought state law said 75% so research needed to clarify this.  Further discussion will be at next meeting.

Open Forum

Frank reminded everyone to follow the rules and wait to speak until recognized by the chair and everyone else to remain silent.

Tracy asked if anyone had ideas for making money besides the Flea Market.  Museum mentioned but it is too costly. Car wash not possible with current water restrictions.  Frank suggested contacting SWWC to add a request to our water bills asking for $1 per month donation.  Linda will contact SWWC.

Mr. & Mrs. Guillauden asked if plans for building a storage & carport must be submitted for approval.  Per Deed Restriction #5, they do.

Ms. Hernandez, owner of property at 12154 Manzanita, asked if she could get a waiver on completion of her house due to problems encountered this past year.  She will submit email request for the board to consider.

Old Business

Letter was sent Nov. 13, 2014 to Robert Isley, owner of property at 11905 Grapevine, regarding the violation of Deed Restriction #1 by having a business, Halloween House, on that property this past October..  No response was received.

Portranco Road expansion due to start end of March, 2015

On Nov 15, 2014, a second Deed Restriction violation letter was sent to Mrs. Veronica Ortiz regarding the structure built at 12205 Poinciana.  An email response to that letter was received through the website with the plans for the house attached.  It is a duplex and may be half on the commercial property behind.  This needs to be checked..

The donation of $200 to the church has not been made yet but Frank will do so this week.

Richard has made copies of the deed restrictions & will get a container to hold them and attach this container to the bulletin board.  The deed restriction sign at the entrance will be put back up when the weather improves.

New Business

Burn Ban is back on..

Trash pick up and taking down the Christmas lights at the entrance will be scheduled when the weather improves.  Linda will send an email.

Next Food Drive is Jan. 16, 2015.  Volunteers report to the church at 1:00 PM.  Richard will get the 2015 schedule from Pastor Rob

Open Forum

Mr. Cortinas stated that he contacted the Hwy Dept about reducing speed on Grosenbacher from 35  to 30 mph and has not heard anything.

Question raised as to whether or not Coolcrest is included in the proposed extension of the city limits.  Both Frank & I said it didn’t look like it from the drawing we saw.

Dana Aguirre said that she had set up a Coolcrest neighborhood private website through Nextdoor.  You can use it to report crime, sell items, post lost pet info, etc.  She will send me an email with the information that I will forward to our residents.

Linda will get possible Flea Market dates for this year.

Richard to get with Mr. Navarro regarding a structure that he is building at 12112 White Birch.

Food Bank Distribution on Oct 17 went very well.

New Business

A certified letter and a regular mailed letter were sent to Mrs. Veronica Salas Ortiz at 12205 Poinciana for violation of deed restriction #5, building a structure without prior review of plans and approval by the board.  Mrs. Ortiz has not responded.  A follow-up letter will be sent.

Burn Ban is still in effect until Nov. 14, 2014

Next food drive is Nov 14 and then on  Dec 12

A motion was made and approved to donate $200 to the Christian Family Baptist Church.  We appreciate them letting of us their facilities.

Discussion held on how to make sure property owners are aware of the deed restrictions.  Southwestern Development created the deed restrictions which were then passed to the Property Owner’s Association.  The deed restrictions were extended on January 26, 1999 and would renew automatically every 10 Years.  Richard will make copies and put them in a container up by the bulletin board so that property owners can take one.

There was a house at 11905 Grapevine that operated a Haunted House around Halloween and charged $3.00.  A letter will be sent advising them that they can not operate a business in the residential area.

Lot at 12153 Poinciana has been cleared and the case dismissed by the county.

We sold 11 spaces at the Flea Market.

New Business

A downed speed limit sign on Yellow Birch and a leaning School Bus Stop sign on Silver Maple have been fixed.

Stage 4 water restriction letters were mailed out to residences and there is a burn ban in effect until Nov. 14, 2014

Upcoming food drives at the church are Sept 12, Oct 17, Nov 14 & Dec 12.  Volunteers are needed. Report at 1:00 PM

Next Flea Market will be Oct 4, 2014

If you see lots with a lot of trash, old vehicles, etc, report them to Bexar County Code Compliance at 210-335-6700

The owner of the lot at 11912 Potranco Rd. is trying to lease the property and Richard contacted the owner, Gurkirat Bhinder, to advise him of the deed restrictions.  Ms. Neisha Dilelio is considering the property and was also contacted and advised of the deed restrictions.  Approval of the type of business and building plans must be submitted to the Board prior to construction.

Mr. Cortinas of 12315 Bois D’Arc stated that he no longer has any tenants in his apartments The only residents are he & his wife, his in-laws, 2 sons and a daughter.  Richard asked him if would now sign the agreement that in the future, he would comply with all deed restrictions.  He refused.  Mr. Cortinas wanted the deed restrictions changed and was informed of the procedure needed to do that.  Mr. Cortinas will send copies of the documents concerning his eviction of his tenants to Richard..
